USING CJ BEATTY SOFTBALL ACADEMY
PURCHASES & MEMBERSHIPS
1. OUR SERVICES
The information and Services offered through CJ Beatty Softball Academy are intended for educational, informational, and developmental purposes.
Our content may include softball instruction, mindset education, confidence training, leadership development, goal setting, challenges, community participation, downloadable materials, live sessions, recorded lessons, and other athlete-development resources.
The Services are not a substitute for individualized medical, psychological, therapeutic, nutritional, physical therapy, or other licensed professional advice.
You are responsible for determining whether any activity, exercise, drill, or recommendation is appropriate for you or your child.
Participation in sports and physical activity involves inherent risks, including the possibility of injury. Participants should use appropriate equipment, adequate space, proper supervision, and reasonable judgment when performing physical activities.
You are responsible for complying with all laws and regulations applicable in your location.

Unless otherwise stated, CJ Beatty Softball Academy owns or licenses the content made available through the Services, including videos, lessons, training materials, graphics, photographs, music, audio, downloads, worksheets, challenges, written content, designs, branding, logos, trademarks, course materials, and other resources (“Content”).
The Content is protected by applicable copyright, trademark, intellectual property, and unfair competition laws.
Your purchase or membership grants you a limited, personal, non-exclusive, non-transferable, and revocable right to access the Content for your own or your athlete’s personal use.
You may not reproduce, copy, resell, redistribute, publish, upload, share, publicly display, commercially exploit, or create derivative works from our Content without prior written permission.
One membership or purchase may not be shared between unrelated households, teams, organizations, coaches, or other individuals unless we expressly authorize such use.

Music, audio recordings, video content, slogans, graphics, performances, or other creative works featuring CJ Beatty may be separately protected by copyright, trademark, publicity rights, licensing agreements, or other intellectual property protections.
Access to the Academy does not grant permission to commercially reproduce, distribute, synchronize, remix, publish, or otherwise exploit such works.

Feedback and Submissions
If you voluntarily provide feedback, suggestions, ideas, or recommendations regarding our Services, you give us permission to use that feedback to improve, market, or develop our Services without compensation to you.

By using the Services, you represent that the information you provide is truthful, accurate, current, and complete.
You further represent that you have legal capacity to agree to these Terms or, if you are acting for a minor, that you are the minor’s parent or authorized legal guardian.
You agree not to use the Services for any unlawful, fraudulent, abusive, harmful, or unauthorized purpose.
Parents and guardians are responsible for the participation and online activity of minors using an account they created or authorized.

You are responsible for maintaining the confidentiality of your username, password, and account credentials.
You are responsible for activity occurring through your account unless you promptly notify us that your account has been compromised.

Programs, memberships, downloads, training opportunities, resources, and other products are subject to availability.
We may add, update, modify, discontinue, rename, replace, or restructure any product, feature, lesson, challenge, community activity, or Service when reasonably necessary.
Descriptions and images are provided to help explain the Services but may be updated as programs evolve.
Prices are subject to change.

When you make a purchase, you agree to provide accurate and current billing and payment information.
Payments may be processed by third-party payment providers available through our checkout system.
All charges are displayed before completion of purchase. Applicable taxes may be added where required by law.
You authorize us and our payment processor to charge your selected payment method for the amount shown at checkout.
For recurring memberships, you also authorize future recurring charges in accordance with the subscription terms disclosed at purchase.
We reserve the right to correct genuine pricing or technical errors and to refuse or cancel fraudulent, unauthorized, or improperly processed transactions.

Billing & Renewal
If you purchase a recurring membership, your subscription will automatically renew at the applicable billing interval shown at checkout until canceled.
You authorize recurring charges to your payment method without requiring separate approval for each renewal.

Cancellation
You may cancel your subscription in accordance with the cancellation method available through your account or by contacting our team at [CANCELLATION METHOD / CONTACT PAGE].
Unless otherwise stated, cancellation stops future renewal charges and becomes effective at the end of the current paid billing period.
Canceling does not automatically create a refund for previous payments.

Fee Changes
We may adjust subscription pricing in the future. Existing subscribers will receive notice of material recurring price changes when required by applicable law.

 All sales are final and payments are non-refundable unless otherwise required by applicable law or expressly stated in writing for a particular offer.
For recurring subscriptions, canceling prevents future renewal charges but does not retroactively refund previous billing periods.

You may use the Services only for their intended personal and educational purposes.
You may not:
- Copy, scrape, download, archive, reproduce, or systematically collect Academy Content beyond permitted personal use.
- Share paid Content, login credentials, downloads, videos, or member resources with unauthorized individuals.
- Resell or commercially distribute Academy Content.
- Attempt to bypass access controls, paywalls, security systems, or account restrictions.
- Upload malware, malicious code, automated scripts, bots, or other technology intended to interfere with the Services.
- Impersonate another person.
- Harass, threaten, bully, intimidate, exploit, or abuse another member.
- Post sexually explicit, hateful, discriminatory, defamatory, violent, or illegal content.
- Solicit minors for inappropriate personal contact.
- Collect personal information about other users without permission.
- Use the community for unauthorized advertising, recruiting, spam, or commercial solicitation.
- Infringe copyrights, trademarks, publicity rights, privacy rights, or other rights belonging to another person.
- Use the Services for any illegal or fraudulent purpose.
- Attempt to reverse engineer, interfere with, or compromise our website, applications, systems, or software.
Violation of these rules may result in removal of Content, suspension, termination, or other appropriate action.

Certain portions of the Services may allow users to post comments, photographs, videos, questions, responses, progress updates, challenge submissions, reviews, or other materials (“Contributions”).
You remain responsible for the Contributions you submit.
You represent that you have the legal right to submit any Content you upload and that your Contribution does not violate another person’s privacy, intellectual property, publicity, or other legal rights.
If a Contribution contains an identifiable minor other than your own child, you are responsible for obtaining all necessary permissions before posting it.
Do not post confidential or highly sensitive personal information within public or community areas.
We may remove Contributions that we reasonably believe violate these Terms, community standards, safety expectations, or applicable law.

When you voluntarily post a Contribution within an Academy community or interactive feature, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and distribute that Contribution as reasonably necessary to operate the Service where you posted it.
We do not claim ownership of your original Contributions.
Any use of a member’s name, photograph, video, likeness, or testimonial for external paid advertising, promotional campaigns, or marketing materials will remain subject to any additional permissions or releases required by applicable law or our separate media consent processes.

Reviews should reflect genuine firsthand experiences.
Reviews may not contain false statements, unlawful threats, harassment, hate speech, confidential information, impersonation, fabricated experiences, or material that violates another person’s rights.
We reserve the right to moderate or remove reviews when reasonably necessary to protect users, comply with law, or enforce these Terms.
Providing a review does not guarantee publication.

We reserve the right to manage the Services in order to protect our users, business, intellectual property, technology, and community.

We are not obligated to monitor every user interaction or Contribution.

Informal Resolution
Before filing a formal legal claim, you and CJ Beatty Softball Academy agree to first attempt in good faith to resolve the dispute informally.
Written notice describing the dispute should be provided to the other party.
The parties should allow at least thirty (30) days for informal resolution unless immediate relief is reasonably required.
Arbitration / Court Provision

EVERY ATHLETE DEVELOPS DIFFERENTLY.
PARTICIPATION IN SOFTBALL, FITNESS ACTIVITIES, DRILLS, EXERCISE, AND OTHER PHYSICAL ACTIVITY CARRIES INHERENT RISK.
YOU AND, WHERE APPLICABLE, YOUR CHILD PARTICIPATE VOLUNTARILY AND ARE RESPONSIBLE FOR USING APPROPRIATE EQUIPMENT, SUPERVISION, SPACE, AND SAFETY PRECAUTIONS.
OUR CONTENT IS NOT MEDICAL, MENTAL HEALTH, PHYSICAL THERAPY, OR OTHER LICENSED PROFESSIONAL ADVICE.
